چکیده
بحران کرونا یا کووید -19 که از نوامبر 2019 در چین آغاز شد و به سرعت جهان را تحت تأثیر قرار داد، سوالات مهمی را در ارتباط با مسئولیت دولت های درگیر با این بحران مطرح نمود. یکی از مهمترین این مسائل، تعیین قواعد رفتاری دولت ها در برخورد با این بحران در جهت پیشگیری، کنترل و مقابله برای حفظ حقوق شهروندان و دولت‌های دیگر بود. اصل تکلیف دولت ها به اتخاذ «تلاش بایسته» در برابر بحران ها یکی از قواعد ناظر بر رفتار حاکمیت‌ها در ایفای تعهدات بین‌المللی آنها می باشد. اگر چه محتوای این اصل به عنوان یکی از هنجارهای رفتاری دولت‌ها برای حمایت از حقوق «دیگران» موضوع تازه‌ای نیست، با این همه ویژگی‌های این بحران در اجرای آن باید مورد توجه قرار گیرد. در پژوهش حاضر با استفاده از روش توصیفی و تحلیلی بر پایه مطالعات اسنادی با ابزار فیش برداری، تعهدات بین المللی دولت برای تامین اقلام و تمهید روش های پیشگیری، کنترل و مقابله با بیماری های همه‌گیر ازجمله کووید-19 مورد تدقیق، تحلیل و بررسی قرار گرفته است و در نتیجه ماحصل یافته ها بیان می گردد که دولت ها وظیفه دارند اقدام‌های لازم از قبیل قانون گذاری انجام و در چارچوب منابع و امکانات خود مقدمات و زمینه های لازم برای تحقق حقوق بشر و بهره مندی افراد از حقوق خویش را فراهم آورند.

The Corona or Covid-19 crisis, which started in China in November 2019 and quickly affected the world, raised important questions regarding the responsibility of the governments involved in this crisis. One of the most important of these issues was determining the rules of behavior of governments in dealing with this crisis in order to prevent, control and counter to protect the rights of citizens and other governments. The principle of the duty of governments to adopt "due effort" against crises is one of the rules governing the behavior of governments in fulfilling their international obligations. Although the content of this principle as one of the behavioral norms of governments to protect the rights of "others" is not a new issue, with all these characteristics of this crisis, it should be considered in its implementation. In this research, using the descriptive and analytical method based on documentary studies with the tool of taking receipts, the international obligations of the government to provide items and prepare methods of prevention, control and dealing with epidemic diseases, including covid-19, are scrutinized, analyzed and It has been investigated and as a result of the findings, it is stated that the governments have the duty to take the necessary measures such as legislation and within the framework of their resources and facilities, the necessary preparations and grounds for the realization of human rights and the enjoyment of people's rights. to provide
